Assessor Terms of Service

These terms ("Terms") apply to you if you have been invited to act as an Assessor — reviewing and/or scoring Submissions — on GoodSubmissions, a platform provided by Good Technologies Limited, a private limited company registered in England with number 11189871, whose registered office is at Jactin House, 24 Hood St, Manchester M4 6WX, UK ("we", "us" or "our"), available at goodsubmissions.org and any subdomain of it ("Website", "Service").

By accepting an invitation to act as an Assessor, you agree to be legally bound by these Terms and by our Privacy Policy. If you do not agree, you should decline the invitation and must not access any Submission.

These are one of three sets of terms we use. Customers and their Admins are bound by our Admin Terms of Service, and Applicants and Co-authors are bound by our Applicant & Co-author Terms of Service. You are not a party to either of those documents.

Definitions

  • Client — the Customer organisation that invited you to act as an Assessor and that runs the Programme(s) you are assessing.
  • Programme — the application, entry, recruitment, competition, or other submission process run by the Client that you have been assigned to assess.
  • Submission — the application, entry, nomination, or other content (which may include documents, images, audio, or video) made by an Applicant or Co-author in connection with a Programme.
  • Assessment Content — any score, note, comment, recommendation, or conflict-of-interest declaration that you submit through the Service in the course of assessing a Submission.

Your role and access

Your access to the Service is scoped to the specific Programme(s), and within them the specific stage(s), that the Client assigns to you. You must not attempt to access a Submission, stage, or Programme you have not been assigned to.

The Client determines the assessment criteria, scoring methodology, and process for its own Programme(s). We have no role in, and no responsibility for, the outcome of any assessment or any decision the Client makes on the basis of your Assessment Content.

Confidentiality

Everything you see through the Service in the course of assessing a Submission — including the Submission itself, any personal data it contains, and any information about other Assessors, Admins, or the Client's internal process — is confidential. You must not disclose it to anyone else, use it for any purpose other than assessing the Submission for the Client, or retain copies of it outside the Service once your assessment is complete.

The Client may require you to sign a separate confidentiality and/or conflict-of-interest undertaking before granting you access. Where it does, that undertaking applies in addition to this clause, and you must comply with both.

Conflicts of interest

If you have any personal, financial, professional, or other relationship with an Applicant, Co-author, or Submission that could reasonably be seen to affect your objectivity, you must declare this through the Service's conflict-of-interest mechanism before beginning, or as soon as you become aware of it during, your assessment, and must not assess that Submission unless the Client confirms you may continue.

Assessment Content

You grant the Client, and us insofar as necessary to provide the Service, a non-exclusive, worldwide, royalty-free licence to store, reproduce, and use your Assessment Content for the purposes of administering the relevant Programme. You retain no right to have Assessment Content removed once submitted, except at the Client's discretion.

You warrant that your Assessment Content will be your own genuine assessment, given in good faith, and will not contain material that is defamatory, discriminatory, or otherwise unlawful.

Acceptable conduct

You must not: (i) post or transmit any material that is threatening, defamatory, obscene, discriminatory, or otherwise unlawful; (ii) attempt to circumvent the access controls that scope your assessment to specific Programmes or stages; (iii) share your login credentials with anyone else; or (iv) use the Service for any purpose other than assessing the Submissions you have been assigned.

No fee; no warranty

We do not pay you, and payment (if any) for your role as an Assessor is a matter between you and the Client, not us. The Service is provided "as is". We do not warrant that the Service will be available at all times or free from error, and we do not warrant that it will meet your particular accessibility needs, although we design it with accessibility as a core objective.

Data protection

Good Technologies acts as a data processor for personal data submitted through the Service, including your own account data and any Assessment Content you provide, under instructions from the Client, who is the data controller. Our Privacy Policy explains this in more detail, and our Data Processing Agreement with the Client (to which you are not a party) sets out the technical detail of that processing.

Liability

We do not exclude or limit our liability to you for fraud, death, or personal injury caused by our negligence or wilful misconduct, or any other liability that cannot be excluded or limited under applicable law.

Subject to the above, our total liability to you in connection with these Terms or your use of the Service, whether in contract, tort, or otherwise, shall not exceed £100, and we shall not be liable for any indirect or consequential loss, loss of income, or loss of opportunity.

Nothing in these Terms affects any statutory rights you have that cannot lawfully be limited or excluded.

Suspension and ending your access

The Client, or we, may suspend or end your access to a Programme or to the Service at any time, including where your assignment ends, where you breach these Terms, or where the Client no longer requires your services as an Assessor. We may also suspend access for system maintenance or security reasons.

If you are also an Admin

If you are, or later become, an Admin for a Client (for example, staff of the organisation running the Programme), your use of the Service in that capacity is additionally governed by our Admin Terms of Service.

Changes to these Terms

We may update these Terms from time to time. Where a change is material, we will give you reasonable advance notice by email before it takes effect — this will not be less than the time remaining on any assessment you have in progress when notice is given, and a change will not apply retrospectively to a conflict-of-interest declaration or piece of Assessment Content you have already submitted. If you continue to access the Service after the date a change takes effect, this constitutes your acceptance of the updated Terms. If you do not agree to a change, you should stop accessing the Service and notify the Client.

General

These Terms, together with our Privacy Policy, constitute the whole agreement between you and us in relation to your use of the Service as an Assessor. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales, and the courts of England have exclusive jurisdiction over any dispute arising from them.
